Terms of Service

These Terms of Service ("Terms") govern your use of the Ember iOS application ("the App"), published by mkAppLab ("we", "us"). By downloading, installing, or using the App, you agree to these Terms.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by Apple's App Store Terms.

2. Subscriptions and Purchases

Ember offers optional auto-renewable subscriptions to unlock premium features. Pricing and duration are displayed in the App before purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription via your Apple ID account settings on your device.
• Refund requests are handled by Apple in accordance with Apple's policies.

3. Medical Disclaimer

Ember is a wellness, tracking, and journaling tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The "weekly verdict", PDF reports, and any analyses produced by the App are for informational purposes only and are not medical advice. Always consult a qualified healthcare professional regarding any medical concerns, symptoms, or treatment decisions, including hormone replacement therapy.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.
• Use the App for any unlawful purpose or in violation of any applicable regulation.
• Attempt to interfere with the App's security or integrity.

5. Your Content

You retain all rights to the symptom logs, journal entries, and other content you create within the App. Because this content is stored on your device (or, optionally, in your private iCloud container), we do not have access to it and do not claim any rights over it.

6. Intellectual Property

The App, including its design, code, branding, and copy, is owned by mkAppLab and protected by copyright and other intellectual property laws. The "Ember" name and visual identity are trademarks of mkAppLab.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any analyses or summaries are accurate or suitable for any particular purpose.

8. Limitation of Liability

To the maximum extent permitted by law, mkAppLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the App. Our total liability shall not exceed the amount you paid us for the App in the 12 months preceding the claim.

9. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App if you materially breach these Terms.

10. Changes

We may update these Terms from time to time. Material changes will be communicated through the App or our website. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which mkAppLab is established, without regard to conflict of laws principles. Mandatory consumer protection rights in your country of residence remain unaffected.

12. Apple Notice (EULA)

You acknowledge that these Terms are between you and mkAppLab, not with Apple. Apple is not responsible for the App or its content. In the event of any conflict between these Terms and Apple's Standard EULA, the more protective terms for the user shall apply with respect to your use of the App.
